Accutane Class Action
The dermatological drug Accutane is used for the treatment of severe acne. It is also prescribed in generic form under the name Isotretinoin. Accutane is a form of Vitamin A that decreases the amount of oil that the skin produces. In turn, this medication is typically successful in clearing up most cases of acne. To date, it has been prescribed to over sixteen million people for the treatment of acne.
While Accutate can be an effective medication, it can also lead to some very serious side effects. In fact, it is has been linked to Crohn's Disease, Ulcerative Colitis, and Inflammatory Bowel Disease. Studies show that users of Accutane or Isotretinoin are four times more likely to develop Ulcerative Colitis than non-users.
In June of 2009, Accutane was recalled by Roche Pharmaceuticals due to the numerous reports and lawsuits from people that claim to have been injured by the drug. Since that time, Accutane has not been available in the United States. However, it is still prescribed in its generic form by many physicians to this day.
If you have been affected by taking the drug Accutane and have developed Crohn's Disease, Ulcerative Colitis, or Inflammatory Bowel Disease, it is imperative that you take action. Accutane lawsuits are limited by statutes so time is of the essence if you have been affected by the medication.
In order to file a lawsuit against the manufacturer of Accutane, you simply need to have been diagnosed by your doctor as having Crohn's Disease, Ulcerative Colitis, or Inflammatory Bowel Disease that was caused by Accutane.
The first step of the process in filing a lawsuit against the manufacturer of Accutane is to obtain a lawyer. A lawyer can guide you through the entire process of your lawsuit and increases your chances of having your claim decided in your favor. He or she will support you throughout the lawsuit process by answering any questions or concerns you may have. Your lawyer will also represent you should your case go to court.
Many Accutane lawsuits are actually settled out of court once the appropriate evidence is gathered and presented to the manufacturer.
Thousands of people have filed lawsuits due to the adverse symptoms that they have experienced due to taking Accutane. These plaintiffs not only received monetary compensation for their medical costs but also for pain, suffering and the negligence of Roche Pharmaceuticals.
Since the recall of Accutane in 2009, the manufacturer has paid out millions of dollars in liability lawsuits.
In fact, Andrew McCarell of New Jersey alleged that he developed Inflammatory Bowel Disease after taking the drug for acne in 1995. He was awarded $2.6 million in damages due to the negligence of Roche Pharmaceuticals. They later appealed his case and the retrial was decided in his favor. This time however, McCarell was awarded $25.16 million for his pain and suffering.
There are many other cases similar to Andrew's, which is why it is imperative for victims of Roche Pharmaceutical negligence to contact an attorney as soon as possible. If you have been adversely affected by Accutane and have developed the conditions described, you deserve compensation and more importantly, justice.
